Inheritance
Czech probate starts on its own after a death and is run by a notary as court commissioner. Heirs can accept, accept with an inventory so that they answer for debts only up to the value inherited, or refuse within the deadline: one month, or three months for an heir living abroad. Heirs abroad can take part through a Czech lawyer with a power of attorney.
Quick answers
- Who runs probate in the Czech Republic?
- The court opens it on its own after a death and appoints a notary as court commissioner, who contacts the heirs and establishes the estate.
- How long do I have to refuse an inheritance?
- One month from the court's notice, or three months if you live abroad (Civil Code, Section 1485). A refusal cannot be withdrawn.
- Is there inheritance tax in the Czech Republic?
- No. It was abolished in 2014. Heirs living in another country should check that country's rules.
